Mahindra snatches the name of its SUV, now the new electric vehicle will be called 'BE 6', legal fight will continue with Indigo

New Delhi. Mahindra & Mahindra Ltd has decided to change the name of its new electric SUV 'BE 6e' to 'BE 6'. Mahindra has said that it will continue the legal fight against Indigo Airlines' parent company InterGlobe Aviation over the name of the electric SUV. InterGlobe claims that '6E' is its airline's design trademark and has been a part of its identity for the past 18 years.

Mahindra said in a statement that their brand name is 'BE 6e' and not just '6e', which is completely different from Indigo's trademark. The carmaker also said that its product and design are completely different from those in the airline sector and hence there is no possibility of any confusion. Mahindra stressed that the trademark application it has filed is for a completely different industry and product.

Where did the matter start?
On December 3, 2024, InterGlobe Aviation filed a case against Mahindra in the Delhi High Court. They claim that the use of the name Mahindra's new electric SUV BE 6e is an infringement of their trademark '6e'. The airline claimed that '6E' has been an integral part of its identity for the last 18 years. It is a registered trademark, which is widely recognized globally. This matter will go up for hearing in the court on December 9.

InterGlobe said, “Unauthorized use of '6E' in any form is a violation of our brand's reputation and identity. We will take every possible step to protect our intellectual property and brand.”

Indigo also embroiled in trademark dispute
It is noteworthy that Indigo itself has faced a trademark dispute. Tata Motors had objected to the use of the name Indigo. Tata named its sedan car 'Indigo' in 2002, while InterGlobe Aviation started its first flight in 2006 under the name Indigo.

Mahindra's stance
Expressing regret over this controversy, Mahindra said that two big Indian companies should not get entangled in such unnecessary disputes. Mahindra said that we have decided to change the name of our product to 'BE 6' so that the controversy can be ended and we can move forward.”

Mahindra's new electric SUV is BE 6e
Mahindra launched its first “electric origin” SUVs ‘BE 6e’ and ‘XEV 9e’ on 26 November 2024. Just a day before, on November 25, the trademark registrar had accepted the name 'BE 6e' for registration. If this name is registered, Mahindra will get the right to use the name 'BE 6e'.

Mahindra has expressed hope that this dispute will end soon and Indian companies will encourage each other's progress.

New Delhi. The dispute over the use of '6E' trademark has intensified between vehicle manufacturer Mahindra & Mahindra (M&M) and Indigo Airlines' owner InterGlobe Aviation. Mahindra has said that it is trying to find a solution to this issue through mutual dialogue.

On the other hand, IndiGo rejected Mahindra's claim and said that '6E' has been their designer code for the last 18 years. The airline says that any misuse of this code can harm its reputation and brand image.

Mahindra introduced new electric vehicles
Mahindra has recently launched two electric SUVs, BE 6E and XEV9E in the market. '6E' has been used in the name of one of these models, which has become a cause of controversy. IndiGo claims that '6E' is its trademark and has been in use for a long time.

Mahindra responded to this by saying that their BE 6E name is different from Indigo's trademark and does not create any confusion among consumers. Mahindra clarified that it has filed a trademark application for its electric SUV 'BE 6E', which is fundamentally different.

Indigo lodged objection
Reiterating that IndiGo protects its rights on this matter, it said that '6E' is not only a registered trademark but is also part of the airline's identity globally. The airline clarified that any unauthorized use of '6E' is a violation of intellectual property rights.

IndiGo said in the statement, “We are committed to taking every necessary step to protect our trademarks and brand identity. '6E' is an integral part of our identity, and using it without permission hurts our image and rights.”

Chances of legal battle increased
According to reports, Indigo has filed a trademark infringement suit against Mahindra. The airline has sought intervention from the intellectual property division of the court challenging Mahindra's BE 6E trademark.

Both Mahindra and Indigo have given public statements regarding this controversy. However, both the companies are also emphasizing on the possibility of adopting the path of dialogue to reach a solution. Now it has to be seen whether this dispute is resolved by mutual consent or it will be resolved through legal battle.
